Abstract
The medical field is undoubtedly a noble one because it deals with human life, which is regarded as having the highest value of all things on earth. Insuring a patient's safety while they are receiving treatment is the doctor's top priority. It is important to keep in mind, though, that human error is common, and doctors are not exempt from this rule. Not always, however there is a chance of making a mistake in some important situations. It is crucial that doctors carry out their duties with knowledge, skill, and prudence since failing to do so constitutes medical negligence. They shouldn't manage their patients without the necessary technical expertise and specialization. It was found important to establish laws on medical negligence to provide with a relief to claim damages occurred to the patient and also punishments for the professional’s negligent behaviour. In recent times, medical negligence cases are on the rise, whatever the reasons may be, but the ultimate sufferers are the innocent public who consult doctors in a firm belief that finding a cure to their health problems. This article provides with the detailed explanation on challenges faced by the victims of medical negligence & the legal resource or legal remedies that is available against medical negligence. Various laws available under which the affected patient or the party related to the affected patient are Consumer Protection Act 1986, Criminal law and Other Laws.
