Abstract
India isn’t a member to the 1951 “Refugee Convention” and lacks sufficient national statutes either. However,
India is proud of adhering to the idea of not providing shelter to refugees under the broad interpretation of Art.
21 of Indian Constitution. Irrespective of this it still has the highest refugee population in Southeast Asia. Since
its freedom, India has followed an ad hoc administrative strategy to provide assistance to refugees. This raises
concerns about violations of the human rights of refugees, the scarcity of basic services and prejudice among
the refugees themselves. As a result, this article investigates the role of the CNDH and the UNHCR in
preserving the dignity of refugees and recommends ways to strengthen it, such as the drafting of specific laws
or the development of a regional treaty following the principles of the Convention of the Refugee. OAU in
Africa.
