WOMEN PRISONER’S RIGHTS: ANALYSING THE CURRENT SITUATION IN INDIA

Abstract
Human Rights are universal in nature as humans are born with equal dignity and rights. However, in the society
where we live, it becomes a matter of question to the conscience that- Are these moral claims actually equal to all
irrespective of the gender, caste or creed? The society has always condemned the vulnerability of women in all
spheres but has explicitly always stated about how women are respectable and vital. Women as prisoners are always
disrespected and disregarded in the society as it is beyond the patriarchal thought to accept that women can be
penalized too. Though the ratio of women prisoners are comparably less than men, but it has been on several
occasions stressed by the courts in India to focus on gender specific needs of improvement in the prison system.
In a situation of global pandemic, that we all are facing at present the prisoners not only need a reviewed
implementation of reforms but also need to address specifically the gender based needs as these becomes the basic
human rights to all. This article makes a paradigm humane legal analysis of the rights of the women as a prisoner in
India and how far we have actually addressed their issues with possible suggestions that can be considered in the
light of present situation. It highlights upon the different legal reforms that have been brought to uplift the condition
of women and create an awareness of their rights.
